IAB Canada proudly released the finalized version of the TCF Policies for Canada. The completion of these policies is an important step towards contributing to a global approach to responsible, privacy-protected media transactions. As the industry works towards advanced solutions for a cookieless reality, the TCF is being designed as a technology-neutral method for delivering meaningful consent signals in a complex eco-system.
The TCF Framework was originally developed and deployed in the EU to address the GDPR and has since been widely adopted and improved. The Canadianized version aims to provide the industry with a standardized, proven best-in-class code of practice for digital advertising consent signals aiding in compliance for current and future privacy legislation in Canada.
These finalized policies are grounded in current privacy legislation (PIPEDA) and have been revised to incorporate the following:
- Edits made as a result of group feedback to terminology to more accurately reflect PIPEDA. An example of this includes the rephrasing of the definition of “permission” (it now says express or implied consent according to Canadian Privacy Law) and removal of the definition of “Consent” as a result, replacing it with a definition for “Objection”. Also removed was the definition of PII as it is not a legal term but merely a concept in legislation.
- 13-month reminder of consent status has been extended to 18 months.
- Updates have been made to reflect TCF V2.0 including elements such as additional stacks etc.
- Important revisions made to address the ambiguity around implied consent to avoid situations where a Vendor propagates an unknown consent within the Framework (even though, absent the signal, they would likely not do so).
These policies have since been shared with the IAB Tech Lab’s Global Privacy Platform working group who will now begin the process of developing technical specifications for the Canadian string.
